Everyone who registers at Hostolog.com is assumed to have read and accepted this agreement.
This agreement is between Hostolog Information Services (providing the services specified in the services section, referred to as Services) and the person/institution specified in the new customer registration section (referred to as Customer), detailing the use of the website (referred to as Site) operated on the internet address belonging to Hostolog, and the purchase, accounting, and billing of these services. It is deemed signed under the following terms and conditions.
The parties must declare, accept, and undertake that the information written in this agreement is accurate.
This agreement regulates the sections that the customer is allowed or not allowed to do based on the information provided during registration, the services they will receive according to their preferences in orders, and the fees they will pay to Hostolog in return for these services. The descriptions of these services and transactions are as follows.
Membership information is the information entered by the customer during registration. As this information will be taken as a basis in transactions, it is assumed that the customer and member have entered this information correctly and completely.
Hostolog Information Services will provide the services ordered by the customer upon request. Hostolog will acknowledge that it has received the relevant fee with the acceptance message and will undertake to provide the service specified in the order.
The payment method and VAT differences will be specified with the total amount during the order process, and the fees the customer needs to pay based on their monthly or annual payment preferences will be notified by Hostolog. If the sales page of the product(s) has an 'Including VAT' statement, the system will complete the order without calculating VAT.
After the acceptance of the order and confirmation of transactions, Hostolog will provide the control panel, FTP, SQL, and email usernames and passwords related to the service specified in the customer's order. The responsibility for these accounts and passwords lies with the customer, and the customer will be responsible for any damages or losses arising from these.
The customer undertakes to comply with the statements and warnings provided by Hostolog during the service period. The customer declares, accepts, and undertakes to comply with any warnings or notifications issued by Hostolog while using the hosting account. The customer cannot distribute or sell the services provided to them for free and unlimited within the service they have received, either paid or free and/or limited or unlimited, to third parties.
If the customer sends written or verbal content containing defamatory, derogatory, or insulting statements towards the company or its officials, Hostolog reserves the right to terminate the service.
The customer accepts and undertakes to bear and cover any taxes, duties, and similar obligations that are in effect or will come into effect during the use of the domain name, hosting, or services received during the contract period.
The customer accepts and undertakes that they are responsible for all files, documents, and programs hosted within the service, and for all operations performed using the web site and mail services, and that they will bear any legal and penal responsibilities arising from the unlawfulness of these data, information, and statements. Hostolog cannot be held responsible for any issues arising from these. Hostolog does not review, approve, endorse, or take any responsibility for pages created by users before they are sent. Hostolog may terminate user accounts for violating these guidelines or for any other reason or if it believes that it is harmful to its own or any of its users' interests. Hostolog has the right to delete the related service without informing the customer when it becomes aware of illegal actions and acts.
Hostolog cannot be held responsible for any material or moral damages arising from incorrect usage, data content, or all data used with email within the service provided. The backup and storage of these data are the customer's responsibilities. Hostolog will allow the customer to regularly back up and maintain all their data. However, Hostolog is not responsible for any errors, damage, or losses that may arise due to service interruptions or data loss. Unless otherwise specified in the contract text, the backup of the data is the responsibility of the customer.
Hostolog will handle the domain name registration processes ordered and paid for without any problems by the customer. The owner of the domain name registered and ordered, and paid for, is the customer. Hostolog can act on the domain name based on the customer's requests. It will make any arrangements, changes, and transfer requests for the domain name as soon as possible.
If the customer launches a campaign to defame, criticize negatively, or conduct such campaigns in an online environment or other platforms, the account will be deleted from the servers without question, and our company will not accept any responsibility.
The customer is obliged to pay the cargo fee when requesting the invoice for the service at any time to their address. If they do not pay the cargo fee and return the cargo, the cargo fee will be reflected as an invoice in the customer's panel. If the customer insists on not paying the reflected invoice, the products and services in the invoice content will be blocked until the invoice is paid.
If the customer experiences a software issue not caused by Hostolog, they cannot hold our company responsible. Server services are provided as unmanaged, and all responsibility lies with the customer.
The customer will receive the service within 48 hours after making the payment for the ordered service. If they do not receive the service within this period, they can request a refund if desired.
The rights and obligations of the parties begin with the submission of order and payment transactions to Hostolog via the internet under this agreement.
The duration of the contract is the payment period selected by the customer for the relevant service during the order process.
If the parties have not notified that the contract will terminate at the end of the period 10 business days before the end of the contract period, the contract will be extended for the previous contract period under the same terms and conditions (except for changes in fees).
Hosting and reseller accounts are automatically activated by the system after payment approval. Since game servers, VDS (Virtual Server), Dedicated server, etc., require special installation, game servers and VDS (Virtual Server) services are delivered within 24 hours, and Dedicated server services are delivered within 48 hours. The delivery time of services may be extended or shortened depending on the intensity. Our average service delivery time is between 1 and 3 hours.
The fee to be paid in return for the services specified in this agreement is the amount specified during the order process. If the specified fees do not include VAT, they will be calculated and shown to the customer, and the collection will be completed.
Hostolog reserves the right to change prices and tariffs forward without prior notice. The customer declares, accepts, and undertakes that they accept the possible changes in this regard.
If the fee is given in foreign currency, it will be converted to Turkish Lira at the Central Bank's effective selling rate on the invoice date.
The fee must be paid by the end of the 5th business day from the invoice date. If there is a credit card payment instruction during the order process, it will be charged from the credit card account. If there is no credit card payment instruction, it must be paid to the bank account numbers specified in the customer contact address or directly to Hostolog.
In case of delay in payment, Hostolog reserves the right to issue an exchange rate difference invoice.
Hostolog reserves the right to suspend or open the relevant service until the customer completes the payment process.
As specified during the order, no refunds are made for domain/SSL certificates and server services (colocation, dedicated, virtual servers, game servers).
Server space purchased from the "Game Servers" section cannot be used for purposes other than the intended purpose and is limited to the section where the service is purchased. In case of any violation, Hostolog reserves the right to suspend the service and issue an additional invoice.
In case of payment problems, issues with credit card payment instructions, or due to articles related to provisions and obligations, Hostolog reserves the right to suspend all services provided to the customer, including email, web, and FTP accounts.
During this period, email, web, and FTP access for the customer will not be available, and email accounts will be blocked, and incoming emails will be returned.
The maximum CPU and RAM usage per site on the server is 20%. User accounts that exceed 20% will be suspended after the first warning. In this regard, the CPU rates specified in special campaigns or special packages apply. Hostolog reserves the right to close or cancel the website or services that exceed the CPU rates without notifying the customer if Hostolog is in a difficult situation. You cannot run a “cron” for less than 60 minutes. All hosting packages are suspended if your account uses CPU at 100% that risks system activity. Hosting services cannot be used for file archiving purposes.
It is prohibited to host content on our servers that violates copyrights or Turkish laws. This content includes, but is not limited to, brute force-spam-ddos, hacking, cracking, warez, adult, and all files containing copyrights.
The security of all software on the servers is the responsibility of our customers. Hostolog is not responsible in any way for any issues that may arise from Chmod 777 or related to your software.
If the customer does not pay their invoice by the specified payment date for server services, the service will be suspended for 3 hours. Hostolog is not responsible for anything that happens after the 3rd hour.
It is prohibited to perform high bandwidth output and DDoS attacks through our servers. In case of such a situation, Hostolog reserves the right to cancel the service without consulting the customer.
Our server services include a 1GBiT/s standard copper port connection. If our customers use more than 100MBiT/s for more than 10 minutes, Hostolog will warn the customer and, if repeated, reserve the right to cancel the service.
It is forbidden to open prohibited sites with the services provided by our company.
Using virtual servers for upload/download purposes will result in the termination of the service.
Performing Bitcoin and derivative transactions through virtual servers, which will overload the server's CPU, RAM, disk, or internet, will result in the termination of your service.
If the customer violates any clause of this agreement or fails to fulfill their responsibilities and commitments, or if the information they declared on the front page of this agreement is found to be inaccurate, or if the suspension of the contract specified above continues for more than 3 hours, Hostolog reserves the right to unilaterally terminate the contract without any warning or notice. In such a case, the customer cannot request the refund of the last contract fee paid, regardless of the remaining period, and undertakes to pay a commercial penal compensation equal to 5 times the equivalent contract fee in effect at the time of termination.
The customer has the right to terminate this contract without showing any reason, provided they notify in writing 10 days before the normal expiration date. If the customer terminates the contract before the expiration date, they undertake to pay half of the fees to be paid until the end of the contract in a lump sum and in advance.
The parties declare, accept, and undertake the postal addresses specified in the order address as their legal residence for any notifications arising from this agreement.
Any notification made to these addresses will be considered delivered even if it does not reach the parties. Changes to these addresses will be valid only if notified in writing to the other party.
Hostolog may send messages, information, notices, warnings, payment notifications, account activity charts, and account statements to the customer's declared email address during the contract period. The customer declares, accepts, and undertakes that they cannot claim that these electronic communications were not received or did not reach them and that they will be deemed legally notified 1 day after the date of sending.
If the customer fails to make the payment for the services received within 7 days following the application date, they will be considered in default. In this case, Hostolog may issue an exchange rate difference invoice or demand a monthly 25% delay interest from the invoice date. The customer declares and accepts to pay this delay interest and exchange rate difference invoice.
If Hostolog initiates legal action or enforcement proceedings for any receivables arising from this agreement, the customer declares, accepts, and undertakes to pay a monthly 25% delay interest, a penalty clause equal to 50% of the remaining debt amount, 10% attorney fee, and all other legal expenses.
If Hostolog applies for precautionary attachment and precautionary injunction to legal authorities for the collection of receivables arising from this agreement, the customer accepts and undertakes that Hostolog is authorized to obtain precautionary attachment and precautionary injunction decisions without a bond, but if a bond is required by the courts, they will pay the commissions and all expenses arising from the bank guarantees and will not object to these issues.
If the payment for the service received is not made on time, Hostolog has the right to suspend the service without notice and, if the fee is not paid within 3 hours from the due date, to permanently delete the service. Customers subject to this application accept that they will not request backups or reactivation of the service.
In hosting servers (shared servers), each customer has the right to use up to 25% CPU to ensure equal rights for everyone. Websites that perform operations outside the hosting capacity are suspended with or without warning. Hostolog is not responsible for any damages arising from this.
Unlimited web hosting services can only be used for hosting website files and cannot be used for data storage, backup, or hosting mp3, rar, exe files.
Each hosting account has a 5MB I/O limit.
If Hostolog accepts the refund request, and the customer cannot issue a refund invoice, Hostolog will deduct the VAT rate and bank transfer/eft fee and refund the remaining amount.
The customer cannot request a refund for the credit uploaded to the system or the subsequent month/year payments made for extension purposes.
A 72-hour (3-day) refund period is given only for Web Hosting services offered from the Turkey location. Refunds are accepted within this period, and refund requests after this period are not accepted.
The customer cannot request a refund for domain names, servers, software, licenses, and other services.
If a refund request is made, Hostolog reserves the right to process this request within a minimum of 5 days and a maximum of 1 month, depending on the company's current decision.
Absolutely no refunds are made for any promotional products.
Our company reserves the right to stop, change, and change prices of the campaign as a result of the campaigns and implement these changes without notifying the customer.
Since servers are electronic devices, there are risks of malfunction despite the necessary and optimal conditions being met. The data center provides the replacement parts for malfunctioning servers.
The company is not responsible for any damages arising from the replacement period of malfunctioning parts and the provision of spare parts. The service recipient cannot claim any rights from the company during this period. They have to wait until the new part and malfunctioning part are provided.
Disks that have fallen into an unrecoverable data position due to RAID configuration errors cannot be recovered. In this case, the RAID will be reconfigured, and if you have backups, your backups will be loaded. Our company is not responsible for RAID configuration and software errors.
In managed services provided with server services, our company does not accept responsibility for the data loss or damage you experience due to mistakes made.
Our company is not responsible for the servers being shut down due to data center or IP changes in server services. The time it takes for devices to become active during relocations is at least 2 and a maximum of 5 business days.
This agreement consists of 13 articles and sub-headings and has been read, understood, and signed by the parties. (It is considered signed when the order is sent to Hostolog via the internet). Hostolog reserves the right to add, remove, or amend articles and/or sub-headings if deemed necessary. The customer declares and undertakes to accept these changes in advance.
Additional invoices may be issued to our customers who receive annual services due to changes in inflation rates during the year.
Izmir Courts and Enforcement Offices are authorized for any disputes arising from the implementation of this agreement.
If Hostolog indicates that it can provide a package with game server services, you need to ask about your package requirements for your game server before purchasing the service. Hostolog personnel have limited knowledge about Game Server Packages and their contents.
Game Server Packages are provided as promotions along with services and are included in the price. It is the customer's responsibility to make adjustments to the packages and make the package available for your players.
We do not guarantee the currency or usability of the packages provided with Game Server Packages. Packages are made as needed and updated by Hostolog if necessary.
During the initial setup phase of game server services, the customer can only get help once. If multiple installations and changes within the package are required, the customer must first get help from non-Hostolog points. Hostolog only provides technical support.
Each customer is given 3 reset rights to use in their virtual servers. Customers who fill their 3 reset rights will be subject to an additional fee for each additional reset right.
In custom operating system installation requests, our customers can only get support once. If multiple custom operating system installation requests are made, they will be subject to an additional fee.
The specified disk space in virtual server services includes the space covered by the operating system and is not assigned separately.
Game servers purchased from Hostolog should only be used to set up the game server in the service category where the order was placed. Otherwise, Hostolog reserves the right to suspend/terminate the service for use beyond its intended purpose.
